Limited Liability Company "COMPANY AKUSTOV" (OGRN: 1151690100869, INN: 1658185391, hereinafter referred to as the "Contractor"), publishes this public offer in accordance with Articles 435 and 437 of the Civil Code of the Russian Federation (hereinafter referred to as the "Offer"), offering physical and (or) legal entities to conclude an Agreement on the following terms.
1. Terms and Definitions
1.1.1. Acceptance — full and unconditional acceptance of the terms of this Offer by performing conclusive actions: starting to use the pages https://akustov.pro/gusta_spray and https://akustov.pro/gusta_spray_en, entering data into feedback forms, ordering a call, or any other interaction with the functionality of the specified pages and their services.
1.1.2. Agreement — an agreement between the Contractor and the User, concluded through the Acceptance of this Offer.
1.1.3. User — a physical or legal entity that has performed the Acceptance of this Offer.
1.1.4. Consumer User — a physical person using the specified pages exclusively for personal purposes not related to the implementation of entrepreneurial activity. The relations with the Consumer User are governed by the provisions of the Law of the Russian Federation No. 2300-1 dated 07.02.1992 "On Protection of Consumer Rights" in the part not contradicting this Offer.
1.1.5. Website — an internet resource located at the domain name https://akustov.pro, including the pages https://akustov.pro/gusta_spray, https://akustov.pro/gusta_spray_en, and related sections where data collection forms, widgets, or links to this document are posted.
1.1.6. Services — informational and consulting services provided by the Contractor in the field of sound insulation, noise protection screens, finishing, and specialized materials (Gusta Spray), as well as providing access to the interactive features of the pages.
2. Subject of the Agreement
2.1. Under this Agreement, the Contractor provides the User with the opportunity to use the pages https://akustov.pro/gusta_spray and https://akustov.pro/gusta_spray_en and their services, and also provides informational and consulting services in accordance with the terms posted on them.
2.2. The use of materials and services of the specified pages is regulated by the norms of the current legislation of the Russian Federation.
2.3. The User is prohibited from:
* using the pages for purposes that contradict the legislation of the Russian Federation;
* carrying out unauthorized access to the management of the pages, bypassing security systems;
* copying, distributing, or using the materials of the pages without the prior written consent ofход Contractor.
3. Acceptance of the Offer and Procedure for Concluding the Agreement

3.2. By making the Acceptance, the User confirms full familiarization with the terms of the Offer, the Privacy Policy, and unconditional agreement with them.
3.3. Acceptance can only be performed by a fully capable person who has reached the age of 18.
4. Rights and Obligations of the Parties
4.1. The Contractor undertakes to:
* ensure the operability of the pages https://akustov.pro/gusta_spray and https://akustov.pro/gusta_spray_en to the extent of technical capabilities;
* process the User's personal data in strict accordance with the Privacy Policy and the requirements of Federal Law No. 152-FZ "On Personal Data".
4.2. The Contractor has the right to:
* change the functionality, structure, and interface of the pages unilaterally;
* make changes to this Offer by publishing a new edition on the Website.
4.3. The User undertakes to:
* provide reliable and up-to-date data when filling out forms on the pages;
* not violate the operability of the pages and not attempt unauthorized access to their elements.
5. Responsibility of the Parties
5.1. The Parties are responsible for non-performance or improper performance of obligations under the Agreement in accordance with the current legislation of the Russian Federation.
5.2. The pages and their services are provided "as is". The Contractor does not guarantee absolute uninterrupted operation of the pages, but makes all reasonable efforts to maintain it.
5.3. The Contractor is not responsible for the User's losses arising from the technical unavailability of the pages or incorrect data entry by the User themselves.
6. Intellectual Property
6.1. All text materials, graphic images, design, trademarks, and other intellectual property objects posted on the pages https://akustov.pro/gusta_spray and https://akustov.pro/gusta_spray_en are the property of LLC "COMPANY AKUSTOV" or are used on a legal basis.
6.2. No materials of the pages may be copied, reproduced, or used without the prior written permission ofход Contractor.
7. Personal Data
7.1. The processing of Users' personal data is carried out by the Contractor in accordance with the Privacy Policy and personal data processing effective on the Website https://akustov.pro and https://akustov.pro/gusta_spray_en.
8. Validity Period and Termination of the Agreement
8.1. The Agreement comes into force from the moment of Acceptance by the User and is valid indefinitely until its termination by either Party.
8.2. The Contractor has the right at any time to unilaterally change the terms of this Offer. Changes come into force from the moment of posting the new edition of the Offer on the Website.
9. Dispute Resolution
9.1. All disputes and disagreements are sought to be resolved by the parties through negotiations. The mandatory pre-trial (claim) procedure for resolving disputes is 30 (thirty) calendar days from the date of receipt of a written claim.
9.2. In case of impossibility to reach an agreement, disputes are submitted for consideration to the court at the location ofход Contractor (for business entities) or at the place of residence of the consumer (for individuals).

1. Общие положения
1.1. Настоящая Политика конфиденциальности и обработки персональных данных (далее — Политика) разработана в соответствии с требованиями Федерального закона от 27.07.2006 № 152-ФЗ «О персональных данных» (с учетом изменений, внесенных Федеральным законом № 420-ФЗ) и определяет порядок обработки персональных данных и меры по обеспечению безопасности персональных данных, предпринимаемые ООО «КОМПАНИЯ АКУСТОВЪ» (далее — Оператор).

1.3. Данные, собираемые автоматически: техническая информация и данные, которые автоматически передаются программным обеспечением страницы и подключенными к нему сторонними сервисами (системы веб-аналитики, такие как Яндекс.Метрика, виджеты, CRM-системы) в процессе использования страницы. К таким данным относятся: IP-адрес, файлы cookies (куки), данные о браузере, операционной системе, геолокации, времени доступа, адресах запрашиваемых страниц и источниках перехода.

Установление с Пользователем обратной связи, расчет стоимости напыляемого акустического покрытия Gusta Spray, консультирование по техническим характеристикам (толщина, цвет, тип помещения), обработка заявок и заказов;
Направление информационных уведомлений, связанных с обработкой запросов и расчетов Пользователя;
Проведение статистических и аналитических исследований на основе обезличенных данных в целях улучшения работы страниц, удобства использования и повышения качества оказываемых услуг.
4. Правовые основания и условия обработки персональных данных
4.1. Обработка персональных данных Пользователя осуществляется на законной и справедливой основе. Правовым основанием обработки является согласие субъекта персональных данных на обработку его персональных данных, а также договоры об оказании услуг и поставке материалов, заключаемые по инициативе Пользователя.
4.2. Обработка персональных данных Пользователя осуществляется без ограничения срока, любым законным способом, в том числе в информационных системах персональных данных с использованием средств автоматизации или без использования таких средств.
4.3. Персональные данные Пользователей хранятся исключительно на защищенных электронных носителях на территории Российской Федерации (соблюдение требований о локализации баз данных).
4.4. Оператор вправе передавать персональные данные третьим лицам (например, подрядчикам или логистическим компаниям, задействованным в исполнении заказа) исключительно с согласия Пользователя либо в случаях, прямо предусмотренных законодательством Российской Федерации (по официальному запросу уполномоченных органов государственной власти).
5. Использование файлов Cookies и систем аналитики
5.1. Страницы используют файлы cookies и метрические программы (в частности, Яндекс.Метрику) для анализа поведения пользователей, сбора статистики посещаемости и оптимизации работы интерфейса расчетов.

6. Процедура реагирования и уведомления об инцидентах (ст. 21.1 152-ФЗ)

В случае выявления инцидента безопасности (утечки, несанкционированного доступа, уничтожения, изменения или блокирования персональных данных), повлекшего за собой нарушение прав субъектов персональных данных, Оператор действует в строгом соответствии со ст. 21.1 Федерального закона № 152-ФЗ «О персональных данных».
6.2. Оператор обязуется направить официальное уведомление в уполномоченный орган по защите прав субъектов персональных данных (Роскомнадзор):
В течение 24 часов с момента выявления инцидента — о самом факте инцидента, его предполагаемых причинах, предполагаемом вреде и о принятых первичных мерах;
В течение 72 часов с момента выявления инцидента — о результатах проведенного внутреннего расследования и о лицах, участие которых привело к выявленному инциденту (при наличии).
7. Права Пользователя, защита и отзыв персональных данных
7.1. Пользователь может в любой момент изменить, обновить или дополнить предоставленную им информацию, направив соответствующий запрос Оператору.
7.2. Пользователь имеет право отозвать свое согласие на обработку персональных данных путем направления письменного заявления в адрес ООО «КОМПАНИЯ АКУСТОВЪ» по юридическому адресу: 420066, Республика Татарстан, г. Казань, ул. Солдатская, д. 8, пом. 15, либо на официальный электронный адрес компании. Отзыв согласия влечет за собой прекращение обработки данных и удаление информации в случаях, предусмотренных законодательством РФ.
8. Изменение Политики конфиденциальности
8.1. Оператор имеет право вносить изменения в настоящую Политику конфиденциальности. Новая редакция Политики вступает в силу с момента ее размещения на страницах akustov.pro/gusta_spray и akustov.pro/gusta_spray_en, если иное не предусмотрено новой редакцией документа.
